Box 51308 <br /> Lafayette, LA 70505-1308 <br /> Re: Ethics Board Docket No. 2017-1329 <br /> Dear Mr. Goudelocke: <br /> The Louisiana Board of Ethics, at its January 19, 2018 meeting, considered your request for an <br /> advisory opinion regarding whether elected Lafayette City-Parish councilmembers may seek <br /> employment with non-profit organizations if the employing non-profit has no financial or <br /> contractual relationship with Lafayette City-Parish Consolidated Government (LCG) and where <br /> LCG has no specific regulatory authority over the activities of the non-profit not equally <br /> applicable to the general public. <br /> The Board concluded, and instructed me to inform you, that generally the Code of Governmental <br /> Ethics does not prohibit Lafayette City-Parish councilmembers from seeking employment or <br /> being employed by non-profit organizations provided the employing non-profit has no financial <br /> or contractual relationship with LCG. La. R.S. 42:1111C(2)(d) prohibits a public servant and a <br /> legal entity in which the public servant exercises control or owns an interest in excess of twenty- <br /> five percent, from receiving compensation for services rendered to any person who has or is <br /> seeking to obtain a business, contractual or financial relationship with the public servant's <br /> agency. <br /> The Board also concluded, and instructed me to inform you, that if a specific employment <br /> opportunity arises in the future for a Lafayette City-Parish councilmember, he or she should seek <br /> an advisory opinion. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The <br /> Board issues no opinion as to past conduct or as to laws other than the Code of Governmental <br /> Ethics.
