You were re-elected Chief of <br /> Police for the Town of Oberlin in 2014 with a term expiring on December 31, 2018. As Chief,you stated <br /> that you are on call twenty-four hours a day and have a maximum salary of thirty-six thousand dollars. <br /> You stated that the Village of Fenton Police Chief and you have come to an agreement whereby you <br /> could work five hours a day part-time for the Village. Included in the agreement is that if you are called <br /> out in your capacity as Chief of Police for Oberlin, you could leave your part-time employment with the <br /> Village. Additionally, you stated that a police vehicle would be issued to you from the Village of Fenton <br /> to perform your duties in your part-time capacity. <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics would not <br /> prohibit you from being employed in a part-time capacity with the Village of Fenton while serving as the <br /> Chief of Police for Oberlin as long as you are only being compensated once for the performance of your <br /> duties in either role. La. R.S. 42:1111A(1)(a) provides that no public servant shall receive anything of <br /> economic value, other than compensation and benefits from the governmental entity to which he is duly <br /> entitled, for the performance of the duties and responsibilities of his office or position. You would be <br /> prohibited from receiving compensation from the Village of Fenton while you were performing your <br /> duties for the Town of Oberlin. Additionally, you should contact the Attorney General's Office <br /> concerning the application of the Dual Office Holdings laws or any other laws that may apply to this <br /> scenario. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented may <br /> result in a different application of the provisions of the Code of Ethics. The Board issues no opinion as to <br /> past conduct or laws other than Code of Governmental Ethics.
