Keith Bartlett <br /> Lycee Francais De La Nouvelle-Orleans <br /> 5951 Patton Street <br /> New Orleans,Louisiana 70115 <br /> Re: Louisiana Board of Ethics <br /> Docket No. 2018-209 <br /> Dear Mr.Bartlett, <br /> The Louisiana Board of Ethics, at its April 20, 2018, meeting, considered your request for an <br /> advisory opinion as to whether the Code of Governmental Ethics ("Code") would prohibit Ben- <br /> jamin Bruhnke from tutoring a set of students currently enrolled at Lycee Francais De La <br /> Nouvelle-Orleans Charter School. <br /> You stated that you are the Principal of Lycee Francais De La Nouvelle-Orleans Charter School. <br /> Benjamin Bruhnke currently teaches multiple grade levels of English & Language Arts at the <br /> school. The parents of a set of triplets currently enrolled in the school have approached Mr. <br /> Bruhnke about tutoring services. For the current school year,two of the triplets are not students <br /> in Bruhnke's class; however the other triplet is in his class. You propose that Mr. Bruhnke pro- <br /> vide tutoring services to the two non-student children for compensation, and that he provide <br /> free tutoring services to the student currently in his class. <br /> La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving anything of economic value for <br /> any service, the subject matter of which is devoted substantially to the responsibilities,programs, <br /> or operations of the agency of the public servant and in which the public servant has participat- <br /> ed. <br /> The Board concluded,and instructed me to inform you, that since tutoring services are substan- <br /> tially related to the teaching responsibilities of the school, Section 1111C(1)(a) would prohibit <br /> Benjamin Bruhnke from receiving compensation for tutoring services provided to a student en- <br /> rolled in his class. The Board further concluded that Mr. Bruhnke would not be prohibited by <br /> Section 1111C(1)(a) from receiving compensation in connection with tutoring the two students <br /> that are not enrolled in his class.
