The position you are trying to fill in the Haughton Police Department would be assigned to <br /> patrol division and would be directly supervised by a patrol sergeant. The position of the Assistant Chief <br /> of Police acts in the capacity as the chief administrative officer for the Haughton Police Department. Both <br /> sergeants in the Department report directly to the Assistant Chief who reports directly to you. Assistant <br /> Chief Bridges is responsible for handling and resolving issues in which the two sergeants he supervises <br /> cannot, He is also responsible for approving all the reports, vacation or sick slips, and scheduling. You <br /> stated that the only involvement Assistant Chief Bridges would have involving the patrol position is <br /> monthly scheduling. Assistant Chief Bridges' son-in-law is Antonio Mims. <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics would <br /> prohibit Antonio Mims from being employed by the Haughton Police Department while Ricky Bridges <br /> serves as the Assistant Chief. La. R.S. 42:1119A provides that no member of the immediate family of an <br /> agency head shall be employed in his agency. La. R.S. 42:1102(3) provides that "agency head" means <br /> chief executive or administrative officer of an agency or any member of a board or commission who <br /> exercises supervision over the agency. As the chief administrative officer of the Haughton Police <br /> Department, Assistant Chief Brides is an agency head. Antonio Mims is considered an immediate family <br /> member to the Assistant Chief. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented may <br /> result in a different application of the provisions of the Code of Ethics. The Board issues no opinion as to <br /> past conduct or laws other than Code of Governmental Ethics.
