The position you are trying to fill in the Haughton Police Department would be assigned to
patrol division and would be directly supervised by a patrol sergeant. The position of the Assistant Chief
of Police acts in the capacity as the chief administrative officer for the Haughton Police Department. Both
sergeants in the Department report directly to the Assistant Chief who reports directly to you. Assistant
Chief Bridges is responsible for handling and resolving issues in which the two sergeants he supervises
cannot, He is also responsible for approving all the reports, vacation or sick slips, and scheduling. You
stated that the only involvement Assistant Chief Bridges would have involving the patrol position is
monthly scheduling. Assistant Chief Bridges' son-in-law is Antonio Mims.
The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics would
prohibit Antonio Mims from being employed by the Haughton Police Department while Ricky Bridges
serves as the Assistant Chief. La. R.S. 42:1119A provides that no member of the immediate family of an
agency head shall be employed in his agency. La. R.S. 42:1102(3) provides that "agency head" means
chief executive or administrative officer of an agency or any member of a board or commission who
exercises supervision over the agency. As the chief administrative officer of the Haughton Police
Department, Assistant Chief Brides is an agency head. Antonio Mims is considered an immediate family
member to the Assistant Chief.
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented may
result in a different application of the provisions of the Code of Ethics. The Board issues no opinion as to
past conduct or laws other than Code of Governmental Ethics. If you have any questions, please contact
me at(225)219-5600 or(800) 842-6630.
Sincerely,
LOUISIANA BOARD OF ETHICS
Or/
._.ter
Brett Robinson
For the Board
AN EQUAL OPPORTUNITY EMPLOYER
