Mumphrey <br /> 12132 Stoneway Place <br /> Baton Rouge, LA 70818 <br /> Re: Ethics Board Docket No. 2018-053 <br /> Dear Mr. Mumphrey: <br /> The Louisiana Board of Ethics,at its May 18,2018 meeting,considered your request for an advisory <br /> opinion as to whether the Code of Governmental Ethics would prohibit you from being employed <br /> by a consultant who may have a contract with the Louisiana Department of Transportation and <br /> Development (DOTD) Gang 004, may have a contract with DOTD other than Gang 004, or may <br /> have a contract with a municipality or parish government. You stated that you retired from DOTD <br /> on September 29,2017 as an Engineer 7 Assistant Bridge Design Engineer Administrator,Gang 004. <br /> You stated that Gang 004 worked on matters involving the Bridge Structural Design Program in <br /> Louisiana. You stated that your duties included supervision of Gang 004, management of Design <br /> Group 004 to develop and deliver bridge projects and provide construction support services. Further, <br /> you managed the Highway Bridge Program and supervised the management of the Bridge Preventive <br /> Maintenance Program. You stated that you were not involved in the selection of consultants for <br /> contract services with DOTD and that you only managed one consultant project with Modjeski and <br /> Masters overseeing the construction of the Louisiana Highway 1 pier removal. <br /> The Board concluded and instructed me to inform you, that the Louisiana Code of Governmental <br /> Ethics(Code)would prohibit you from being employed with a consultant that is under contract with <br /> DOTD Gang 004. Louisiana R.S.42:1121A(1)prohibits a former agency head,for a period of two <br /> years following the termination of his public service as the head of such agency, from assisting <br /> another person, for compensation, in a transaction, or in an appearance in connection with a <br /> transaction,involving that agency or render any service on a contractual basis to or for such agency. <br /> As the agency head for Gang 004,you would be prohibited under the Code of Governmental Ethics <br /> from assisting another person,for compensation, in a transaction or in an appearance in connection <br /> with a transaction involving Gang 004 or render any service on a contractualbasis to or for Gang 004 <br /> for a period of two years from the termination of your public service as the agency head for Gang <br /> 004. Please be advised that as the agency head for Gang 004,the Code would not prohibit you from <br /> working as a consultant or for a consultant under contract with DOTD where the work would be <br /> associated with a Gang other than Gang 004. Furthermore, the Code would not prohibit you from <br /> performing work as a consultant or working for a consultant under contract with a municipality or <br /> parish government, provided that the projects would have not connection with matters involving <br /> Gang 004 . <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
