Blvd. <br /> No. 124 <br /> Baton Rouge, LA 70809 <br /> Re: Ethics Board Docket No. 2018-109 <br /> Dear Ms. Jordan: <br /> The Louisiana Board of Ethics,at its May 18,2018 meeting,considered your request for an advisory <br /> opinion as to whether the Code of Governmental Ethics would prohibit your company, ESTEEM <br /> Youth Programs,Inc.(ESTEEM)from pursuing licensing with the Louisiana Department of Health <br /> (LDH). You stated that you have been employed since May 2012 as a Program Manager 1 of the <br /> Coordinated System of Care (CSoC) within the Louisiana Department of Health, Office of <br /> Behavioral Health(OBH). You stated that your duties include training provider agencies which are <br /> private organizations paid by Magellan Healthcare,Inc.and other family support agencies which are <br /> provided Medicaid-reimbursed fees for service. You stated that you have never provided direct <br /> service to consumers, only provider agencies. You stated that you are the sole owner of ESTEEM, <br /> a non-profit corporation which is a private-pay character education program that serves youth by <br /> conducting summer-focused service activities involving health,academics,community,socialization <br /> and self-mastery. You further stated that you are the Executive Director of ESTEEM,but that you <br /> are not paid. You stated that ESTEEM is interested in becoming a provider of the Independent <br /> Living Skills Building services,which is licensed by the Licensing Division of LDH and credentialed <br /> by Magellan. You stated that ESTEEM would be paid and trained by Magellan which in turn would <br /> be reimbursed by Medicaid,like other CSoC provider types. You stated that you are not paid as an <br /> employee of ESTEEM, however growth of the company may allow for that opportunity. <br /> The Board concluded and instructed me to inform you, that the Louisiana. Code of Governmental <br /> Ethics would not prohibit your company, ESTEEM from being licensed by LDH while you are <br /> employed by LDH. La. R.S. 42:1113A(1)(a)prohibits a public servant or member of such public <br /> servant's immediate family,or legal entity in which he has a controlling interest from bidding on or <br /> entering into any contract, subcontract, or other transaction that is under the supervision or <br /> jurisdiction of the agency of such public servant. Your agency is the CSoC within the LDH. As the <br /> Licensing Division of LDH would supervise any licensing of ESTEEM,your agency(CSoC)would <br /> not be involved in said licensing. Further, as a Coordinated System of Care provider, ESTEEM <br /> would be paid by Magellan Healthcare, Inc.; therefore LDH, and more particularly, CSoC would <br /> have no involvement in the payment of funds.
