Denise Stevenson <br /> 717 Sherron Avenue <br /> Baker, LA 70714 <br /> Re: Ethics Board Docket No. 2018-405 <br /> Dear Ms. Stevenson: <br /> The Louisiana Board of Ethics,at its June 15,2018 meeting,considered your request for an advisory <br /> opinion as to whether the Code of Governmental Ethics would prohibit you from owning a restaurant <br /> in East Baton Rouge Parish which is in Region 2 of the Louisiana Department of Health (LDH) <br /> while being employed as a Sanitarian in Region 2 with LDH. You stated that you are employed as <br /> a Sanitarian in Region 2 with LDH and are assigned to an area including East Feliciana,Zachary and <br /> Baker area and around Region 2 as needed. As a Sanitarian you are responsible for inspection, <br /> investigation, permitting, licensing, and assisting in the enforcement activities of multiple health, <br /> environmental and consumer protection programs relative to retail food establishments. You stated <br /> that you desire to own and/or open a restaurant known as the Barn Yard Café, LLC within Region <br /> 2. The location of the restaurant would be in East Baton Rouge Parish. You stated that you intend <br /> to hire managers who would handle the day to day operations of the restaurant and would also be <br /> responsible for food safety and operations compliance. <br /> The Board concluded and instructed me to inform you, that the Louisiana Code of Governmental <br /> Ethics(Code)would prohibit you from owning a restaurant within Region 2 while you are employed <br /> as a Sanitarian for LDH assigned to an area within Region 2. La.R.S. 42:1113A(1)(a)prohibits a <br /> public servant, or member of his immediate family, or legal entity in which he has a controlling <br /> interest from bidding on or entering into any contract,subcontract,or other transaction that is under <br /> the supervision or jurisdiction of his agency. As a Sanitarian with LDH assigned to Region 2, the <br /> Code would prohibit you from owning a restaurant in Region 2 as it would fall within the jurisdiction <br /> of your agency. Additionally,La.R.S.42:1111C(2)(d)prohibits a public servant and a legal entity <br /> in which the public servant exercises control or owns an interest from receiving any thing of <br /> economic value for services rendered to or for any person during his public service unless such <br /> services are neither performed for nor compensated by any person who(1)has or is seeking to have <br /> a contractual, business or financial relationship with the public servant's agency; (2) conducts <br /> operations or activities that are regulated by the public employee's agency; or(3)has a substantial <br /> economic interest which maybe substantially affected by the performance or nonperformance of the <br /> public employee's official duty.
