Newman <br /> Executive Director <br /> Tensas Council on Aging, Inc. <br /> Post Office Box 726 <br /> Saint Joseph, LA 71366 <br /> Re: Ethics Board Docket No. 2018-514 <br /> Dear Ms. Newman: <br /> The Louisiana Board of Ethics,at its July 20,2018 meeting,considered your request for an advisory <br /> opinion regarding whether the Louisiana Code of Ethics would prohibit the Tensas Parish Council <br /> on Aging (TPCA) from purchasing a building owned by the estate of a deceased member of the <br /> TPCA board. You stated that Arittia Wynn was a board member of the TPCA until her death in <br /> February 2017. Her daughter, Ginger Grissom has been appointed to fulfill the remainder of her <br /> term as board member. A building which the TPCA is interested in purchasing is owned by the <br /> Estate of Arittia Wynn. Ginger Grissom is an heir in the amount of one-third of her mother's estate. <br /> The Board concluded and instructed me to inform you, that the Louisiana Code of Governmental <br /> Ethics(Code)would prohibit the TPCA from purchasing the building currently owned by the Estate <br /> of Arittia Wynn. La. R.S. 42:1113B prohibits an appointed member of any board or commission, <br /> member of his immediate family,or legal entity in which he has a substantial economic interest from <br /> bidding on or entering into or being in any way interested in any contract, subcontract, or other <br /> transaction which is under the supervision or jurisdiction of the agency of such appointed member. <br /> When Arittia Wynn passed away, her daughter as a universal heir was given immediate ownership <br /> of all property in her estate. As a member of the board of TPCA, Ginger Grissom would be <br /> prohibited from contracting or entering into a transaction to sell the building to the TPCA. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than Code of Governmental Ethics.
