Advisory opinion that La. R.S. 42:1119 of the Code of Governmental Ethics would not prohibit either a husband or wife employed by the Department of Speech Language Pathology with Southern University from serving as the Chairperson of the Department of Speech Language Pathology since both have been employed by the agency for more than a year. However, a disqualification plan would need to be submitted to prevent and conflicts of interest posed by La. R.S. 42:1112.

Her husband, Dr. Stephen
Enwefa, has been employed as a faculty member within the Department of Speech Language
Pathology since August 14,2006.As faculty members, neither of you are considered the head of the
department. You ask whether either of you would be prohibited from serving as the Chairperson of
the Department of Speech Language Pathology while the other is employed in the same department.
The Board concluded, and instructed me to inform you, that neither of you would be
prohibited from serving as the Chairperson of the Department of Speech Language Pathology, as
both of you have been employed in the agency for more than one year prior to either of you
becoming the agency head. As an exception to the nepotism prohibition, La. R.S. 42:1119C(2)
allows for the continued employment of a public servant when the public servant has been employed
in the agency for at least one year prior to the immediate family member becoming the agency head.
The Board further concluded, and instructed me to inform you, that La. R.S. 42:1112B(1)
prohibits both of you from participating in transactions in which your spouse has a substantial
economic interest. In the event either of you become the agency head of the Department of Speech
Language Pathology, a disqualification plan should be submitted pursuant to La. R.S. 42:1112C.
AN EQUAL OPPORTUNITY EMPLOYER
