Enwefa <br /> 9618 Jefferson Hwy. #156 <br /> Baton Rouge, Louisiana 70809 <br /> Re: Louisiana Board of Ethics Docket No. 2018-569 <br /> Dear Mr. and Mrs. Enwefa: <br /> The Louisiana Board of Ethics,at its July 20,2018 meeting, considered your request for an <br /> advisory opinion as to whether Section 1119 of the Code of Governmental Ethics would prohibit <br /> either of you from serving as the Chairperson of the Department of Speech Language Pathology with <br /> Southern University in Baton Rouge. <br /> Dr.Regina Enwefa has been employed by Southern University as faculty member within the <br /> Department of Speech Language Pathology since January 5, 2005. Her husband, Dr. Stephen <br /> Enwefa, has been employed as a faculty member within the Department of Speech Language <br /> Pathology since August 14,2006.As faculty members,neither of you are considered the head of the <br /> department. You ask whether either of you would be prohibited from serving as the Chairperson of <br /> the Department of Speech Language Pathology while the other is employed in the same department. <br /> The Board concluded, and instructed me to inform you, that neither of you would be <br /> prohibited from serving as the Chairperson of the Department of Speech Language Pathology, as <br /> both of you have been employed in the agency for more than one year prior to either of you <br /> becoming the agency head. As an exception to the nepotism prohibition, La. R.S. 42:1119C(2) <br /> allows for the continued employment of a public servant when the public servant has been employed <br /> in the agency for at least one year prior to the immediate family member becoming the agency head. <br /> The Board further concluded, and instructed me to inform you, that La. R.S. 42:1112B(1) <br /> prohibits both of you from participating in transactions in which your spouse has a substantial <br /> economic interest. In the event either of you become the agency head of the Department of Speech <br /> Language Pathology, a disqualification plan should be submitted pursuant to La.
