Franckiewicz <br /> Butler Snow LLP <br /> Suite 2700 <br /> 201 St. Charles Avenue <br /> New Orleans,Louisiana 70170-2700 <br /> Re: Louisiana Board of Ethics <br /> Docket No.2018-741 <br /> Dear Mr. Franckiewicz, <br /> The Louisiana Board of Ethics, at its July 20, 2018, meeting, considered your request for an ad- <br /> visory opinion as to whether Section 1121 of the Code of Governmental Ethics ("Code") would <br /> prohibit Candace Watkins from being hired by the Road Home Corporation. <br /> The Road Home Corporation d/b/a/ Louisiana Land Trust ("LLT") is a 501(c)(3) nonprofit <br /> corporation created by Act 654 of the 2006 Regular Legislative Session and governed by La. R.S. <br /> 40:600.61 through La. R.S. 40:600.68. Although LLT is not generally a public entity, it is specifi- <br /> cally governed by the Code pursuant to La. R.S. 40:600.65. LLT's purpose is to hold properties <br /> that are acquired through the Road Home Program,which is a Community Development Block <br /> Grant program administered by the Louisiana Division of Administration, Office of Communi- <br /> ty Development — Disaster Recovery Unit ("DRU"). LLT receives a substantial majority of its <br /> funding through DRU. <br /> Candace Watkins was previously employed by DRU as a Program Manager,where she interfaced <br /> regularly with LLT on matters related to the Road Home Program. She terminated her employ- <br /> ment with DRU on May 18, 2018. You ask whether Ms. Watkins would be prohibited from <br /> working for LLT and being assigned projects which are related to the matters she handled while <br /> employed by DRU. <br /> Section 1121B of the Code prohibits a former public servant, for a two year period following <br /> the termination of his public service, from assisting another person for compensation in a trans- <br /> action in which he participated while employed as a public servant. Section 1102(16) defines a <br /> "person" to mean an individual or legal entity, other than a governmental entity, or an agency <br /> thereof.
