Concealed carry classes are not offered to the public by the St. Martin <br /> Parish Sheriff's Office and are not a part of your public duties as Range Master or Training Di- <br /> rector. You would like to utilize the St. Martin Parish Sheriff's Office firing range to conduct the <br /> classes. The range availability would require approval by the St. Martin Parish Sheriff. <br /> The Board concluded, and instructed me to inform you, that the Code would not prohibit you <br /> from teaching a concealed carry permit class to private citizens. La. R.S. 42:1111C(1)(a) prohibits <br /> a public employee from receiving anything of economic value for any service, the subject matter <br /> of which is devoted substantially to the responsibilities, programs, or operations of the agency <br /> of the public servant and in which the public servant has participated. Since private concealed <br /> carry classes are not a part of the St. Martin Parish Sheriff's Office programs, you are not pro- <br /> hibited from receiving compensation for conducting private concealed carry classes. <br /> However, the Board further concluded, and instructed me to inform you, that the Code would <br /> prohibit you from utilizing the public range at the St. Martin Parish Sheriff's Office for the clas- <br /> ses. La. R.S. 42:1113A(1)(a) prohibits a public servant from entering into contracts, subcontracts, <br /> or other transactions that are under the supervision or jurisdiction of the public servant's agency. <br /> Since the use of the St. Martin Parish Sheriff's Office range would require the St. Martin Parish <br /> Sheriff's approval, you would be prohibited from entering into transactions for the use of the <br /> range. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as pre- <br /> sented may result in a different application of the provisions of the Code of Governmental Eth- <br /> ics.
