Concealed carry classes are not offered to the public by the St. Martin
Parish Sheriff's Office and are not a part of your public duties as Range Master or Training Di-
rector. You would like to utilize the St. Martin Parish Sheriff's Office firing range to conduct the
classes. The range availability would require approval by the St. Martin Parish Sheriff.
The Board concluded, and instructed me to inform you, that the Code would not prohibit you
from teaching a concealed carry permit class to private citizens. La. R.S. 42:1111C(1)(a) prohibits
a public employee from receiving anything of economic value for any service, the subject matter
of which is devoted substantially to the responsibilities, programs, or operations of the agency
of the public servant and in which the public servant has participated. Since private concealed
carry classes are not a part of the St. Martin Parish Sheriff's Office programs, you are not pro-
hibited from receiving compensation for conducting private concealed carry classes.
However, the Board further concluded, and instructed me to inform you, that the Code would
prohibit you from utilizing the public range at the St. Martin Parish Sheriff's Office for the clas-
ses. La. R.S. 42:1113A(1)(a) prohibits a public servant from entering into contracts, subcontracts,
or other transactions that are under the supervision or jurisdiction of the public servant's agency.
Since the use of the St. Martin Parish Sheriff's Office range would require the St. Martin Parish
Sheriff's approval, you would be prohibited from entering into transactions for the use of the
range.
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as pre-
sented may result in a different application of the provisions of the Code of Governmental Eth-
ics. The Board issues no opinion as to past conduct or as to laws other than the Code of
Page 1 of 2 (Docket No. 2018-673)
AN EQUAL OPPORTUNITY EMPLOYER
