Airline Avenue <br /> Gramercy,Louisiana 70052 <br /> Re: Louisiana Board of Ethics <br /> Docket No. 2018-1420 <br /> Dear Mr. Scott, <br /> The Louisiana Board of Ethics, at its December 14, 2018, meeting, considered your request for <br /> an advisory opinion as to whether the Code of Governmental Ethics ("Code") would prohibit <br /> you from providing backflow preventer services to businesses in the Town of Gramercy <br /> ("Town"). You are employed by the Town as the Maintenance Supervisor. Your duties include <br /> general maintenance and repairs,including water cutoffs and restoration, as well as repairs to the <br /> city-owned water lines.You do not perform any maintenance or repairs on private property. <br /> The Town requires certain businesses to install a backflow preventer to avoid contamination of <br /> the water system; however, the Town does not conduct the installation, testing, or servicing of <br /> the backflow preventers. Neither yourself, nor any other employee in the Maintenance Depart- <br /> ment, has any participation with this determination. You recently completed the certification to <br /> become a Certified Backflow Preventer Tester. You would like to start your own business con- <br /> ducting the tests outside of your normal working hours. <br /> La. R.S. 42:1111C(2)(d) prohibits a public servant from receiving anything of economic value for <br /> services provided to a person who conducts operations or activities which are regulated by the <br /> public employee's agency. <br /> The Board concluded,and instructed me to inform you, that you would be prohibited by Section <br /> 1111C(2)(d) from performing compensated backflow preventer testing services for entities in the <br /> Town, while those entities are regulated by the Town. However, you would not be prohibited <br /> from providing backflow preventer services to businesses outside of the Town of Gramercy. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as pre- <br /> sented may result in a different application of the provisions of the Code of Governmental Eth- <br /> ics.
