Airline Avenue Gramercy,Louisiana 70052 Re: Louisiana Board of Ethics Docket No. 2018-1420 Dear Mr. Scott, The Louisiana Board of Ethics, at its December 14, 2018, meeting, considered your request for an advisory opinion as to whether the Code of Governmental Ethics ("Code") would prohibit you from providing backflow preventer services to businesses in the Town of Gramercy ("Town"). You are employed by the Town as the Maintenance Supervisor. Your duties include general maintenance and repairs,including water cutoffs and restoration, as well as repairs to the city-owned water lines.You do not perform any maintenance or repairs on private property. The Town requires certain businesses to install a backflow preventer to avoid contamination of the water system; however, the Town does not conduct the installation, testing, or servicing of the backflow preventers. Neither yourself, nor any other employee in the Maintenance Depart- ment, has any participation with this determination. You recently completed the certification to become a Certified Backflow Preventer Tester. You would like to start your own business con- ducting the tests outside of your normal working hours. La. R.S. 42:1111C(2)(d) prohibits a public servant from receiving anything of economic value for services provided to a person who conducts operations or activities which are regulated by the public employee's agency. The Board concluded,and instructed me to inform you, that you would be prohibited by Section 1111C(2)(d) from performing compensated backflow preventer testing services for entities in the Town, while those entities are regulated by the Town. However, you would not be prohibited from providing backflow preventer services to businesses outside of the Town of Gramercy. This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as pre- sented may result in a different application of the provisions of the Code of Governmental Eth- ics.
