Advisory Opinion whereby the Code of Governmental Ethics would not prohibit an Assistant Program Manager for the Louisiana Department of Hospitals Office of Behavioral Health from providing services to Louisiana Bureau of Emergency Management Services since the Bureau of Emergency Management Services is not a person, however Section 1111C(1)(a) of the Code of Governmental Ethics would prohibit him from providing the same service as he provides for his agency.

Lakeshore Avenue <br /> Prairieville, Louisiana 70769 <br /> Re: Louisiana Board of Ethics Docket No. 2019-264 <br /> Dear Mr. Adams: <br /> The Louisiana Board of Ethics, at its April 12, 2019 meeting, considered your request for an <br /> advisory opinion regarding whether the Code of Governmental Ethics would prohibit you a part- <br /> time employee of Louisiana Department of Hospitals Office of Behavioral Health (LDH/OBH) <br /> from providing services to Louisiana Bureau of Emergency Management Services. <br /> FACTS PROVIDED <br /> You stated that you currently serve as an Assistant Program Manager for LDH/OBH. Your <br /> duties include first responder outreach after disasters. You also provide services to aid in <br /> emergency preparedness. You are a retired Assistant Fire Chief from Baton Rouge. You have an <br /> opportunity to teach Critical Incident Stress Management for the Louisiana Bureau of <br /> Emergency Management Services. You stated that you do not teach Critical Incident Stress <br /> Management for LDH/OBH. <br /> Further, you provided that you currently teach SafeTALK T4T, training regarding suicide <br /> alertness and identification, through the living network.net to other qualified trainers and <br /> LDH/OBH does not currently offer SafeTALK T4T training. However, you want to know if <br /> LDH/OBH was to get a grant to provide SafeTALK T4T training, would you be able to teach <br /> SafeTALK T4T for LDH/OBH. <br /> LAW <br /> La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value <br /> for any service, the subject matter of which is devoted substantially to the responsibilities, <br /> programs, or operations of the agency of the public servant and in which the public servant has <br /> participated. <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
