Hecker, Sr. <br /> 3433 Hwy. 190 PMB243 <br /> Mandeville, LA 70471 <br /> Re: Board Docket No. 2019-555 <br /> Dear Mr. Hecker: <br /> The Louisiana Board of Ethics, at its June 21, 2019 meeting, considered your request for an <br /> advisory opinion regarding post-employment restrictions that would apply to you as a former <br /> employee of Louisiana State University. <br /> FACTS PROVIDED <br /> You stated that you were employed at Louisiana State University as a part-time lecturer for the <br /> Carroll Herring Fire Emergency Training Institute (LSU FETI) until March 2019. During your <br /> employment, you were classified as a Wages As Earned (WAE) Lecturer, and your duties <br /> included teaching fire training classes to various fire departments. One of the fire departments <br /> that you regularly lectured, David Crockett Steam Volunteer Fire Company Number One, has <br /> approached you to teach private lessons outside of the normal LSU FETI training schedule. <br /> LAW <br /> Section 1121B of the Ethics Code prohibits a former public employee, for a period of two years <br /> following the termination of his public employment, from assisting another person, for <br /> compensation, in a transaction involving the agency of the former public employee, in which the <br /> public employee participated at any time during his public employment. Additionally, Section <br /> 1121B prohibits a former public employee, for a period of two years following the termination of <br /> his public employment, from rendering the same service which he rendered during his public <br /> employment on a contractual basis to, for, or on behalf of his former agency. <br /> La. R.S. 42:1102(16) defines "person" to mean an individual or legal entity other than a <br /> governmental entity, or an agency thereof. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics <br /> does not prohibit you from teaching fire training classes to fire departments, including David <br /> Crockett Steam Volunteer Fire Company Number One, since you will not be assisting another <br /> person for compensation in transactions in which you participated while employed by Louisiana <br /> State University or providing these services through a contract involving your former agency. <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
