Box 2473
Ponchatoula, LA 70454
Re: Ethics Board Docket No. 2019-283
Dear Representative Pugh:
The Louisiana Board of Ethics, at its June 21, 2019 meeting, considered your request for an
advisory opinion as to whether you may be employed by the Louisiana House of Representatives
after your term of office as a member of the Louisiana House of Representatives ends.
FACTS PROVIDED
You stated that you currently serve as a member of the Louisiana House of Representatives with
your term of office ending on January 13, 2020. You are considering applying for employment
with the Louisiana House of Representatives after your term of office ends to serve as Capitol
Foundation Coordinator selling state souvenirs to members of the legislature, tourists and
residents. You provided additional information that the Capitol Foundation Coordinator would
also be responsible for handling any issues involving the telephones utilized by members of the
Louisiana House of Representatives. If the position of Capitol Foundation Coordinator becomes
available before your term of office ends on January 13, 2020, you will resign before submitting
an application for the position.
LAW
La. R.S. 42:1121A(2) prohibits a former member of a board or commission from contracting
with, being employed in any capacity by, or being appointed to any position by his former board
or commission for a period of two years following the termination of his public service on such
board or commission.
CONCLUSION
The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics
prohibits you from accepting employment with the Louisiana House of Representatives for two
years after your term of office ends to serve as Capitol Foundation Coordinator. However, if the
Capitol Foundation is created as a separate entity in the future and you are interested in seeking
employment as its coordinator, the Board advises that you should seek an advisory opinion from
the Board.
AN EQUAL OPPORTUNITY EMPLOYER
