Box 15
Lockport, Louisiana 70374-0015
Re: Louisiana Board of Ethics
Docket No. 2019-1115
Dear Mr. Bagala,
The Louisiana Board of Ethics, at its meeting on December 20, 2019, considered your
request for an advisory opinion as to whether the Code of Governmental Ethics ("Code")
would prohibit you from serving in certain positions with Lafourche Parish Government.
FACTS PROVIDED
In February of 2017, you were hired as an Internal Auditor with the Lafourche Parish
Government. On October 12, 2019, you were elected as State Representative—District 54.
You will take office in January of 2020.
You ask whether you are prohibited from continuing in your employment as an auditor and
whether you would be prohibited from being promoted to a department head by the
Lafourche Parish President while you serve as State Representative.
CONCLUSION
The Board concluded, and instructed me to inform you, that the Code would not prohibit
your continued employment or promotion to department head with Lafourche Parish
Government. The Board recommends that you contact the Office of the Attorney General
as to the application of any dual-office holding provisions.
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts
as presented may result in a different application of the provisions of the Code of
Governmental Ethics. The Board issues no opinion as to past conduct or as to laws other
than the Code of Governmental Ethics, the Campaign Finance Disclosure Act,the Lobbyist
Disclosure Act, and conflict of interest provisions in the gaming laws. If you have any
questions, please contact me at(800)842-6630 or(225)219-5600.
Sincerely,
NA BOA ETHICS
\Jaw
David M.
