LeBlanc <br /> 9696 Louisiana Highway 697 <br /> Maurice, LA 70555 <br /> RE: Docket No. 2019-1011 <br /> • <br /> Dear Mr. LeBlanc: <br /> The Louisiana Board of Ethics, at its December 20, 2019 meeting, considered your request for an <br /> advisory opinion as to whether the Code of Governmental Ethics would prohibit you from working <br /> for an environmental consulting firm to perform remediation type activities at Underground Storage <br /> Tank sites and hazardous waste sites in Louisiana once you retire as an Environmental Scientist with <br /> the Louisiana Department of Environmental Quality. <br /> FACTS PROVIDED <br /> You stated that you are employed as an Environmental Scientist 3 with the Louisiana Department <br /> of Environmental Quality("LDEQ") and intend to retire at the end of 2019. You stated that as an <br /> Environmental Scientist 3, you are responsible for conducting compliance inspections of <br /> Underground Storage Tank ("UST") sites in the Acadiana Region of Louisiana. You further <br /> conducted UST installation and closure inspections and responded to UST spill incidents. You <br /> provided that all of your work was limited to the Acadiana Region area. You further provided that <br /> you were not considered to be an agency head and did not supervise anyone as an Environmental <br /> Scientist. You also stated that at no time did you work on matters involving legacy lawsuits. <br /> You stated that following your retirement from LDEQ you would like to work for an Environmental <br /> Consulting Firm to perform soil and groundwater assessment, remediation type activities at UST <br /> sites,conduct field activities at solid or hazardous waste sites,draft permit applications for hazardous <br /> waste sites, and work on legacy lawsuits. <br /> LAW <br /> La. R.S. 42:1121B(1)prohibits a former public employee, for a period of two years following the <br /> termination of his public employment, from assisting another person, for compensation, in a <br /> transaction, or in an appearance in connection with a transaction in which such former public <br /> employee participated at any time during his public employment and involving the governmental <br /> entity by which he was formerly employed,or for a period of two years following termination of his <br /> public employment,rendering,any service which such former public employee had rendered to the <br /> agency during the term of his public employment on a contractual basis,regardless of the parties to <br /> the contract, to, for, or on behalf of the agency with which he was formerly employed. <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
