Guice <br /> 1881 Hudson Circle <br /> Monroe, LA 71201 <br /> Re: Board Docket No. 2019-1207 <br /> Dear Mr. Guice: <br /> The Louisiana Board of Ethics, at its December 20, 2019 meeting, considered your request for an <br /> advisory opinion as to whether an immediate family member of a principal may be employed as a <br /> teacher at the principal's school by the Evangeline Parish School Board(EPSB). <br /> FACTS PROVIDED <br /> You stated that Evangeline Parish has a population of 33,984 according to the latest decennial <br /> census and that the EPSB is experiencing difficulty recruiting and hiring certified teachers. You <br /> posed three questions related to the employment of an immediate family member of a principal: <br /> whether such an immediate family member may be employed as a certified classroom teacher at <br /> the principal's school; whether such employment could take place if a disqualification plan is <br /> submitted to the Board for review and approval; and whether the criteria and limitations set forth <br /> in an attached policy would be sufficient to allow the continued employment of a principal's <br /> immediate family member. <br /> LAW <br /> La. R.S. 42:1119B(2)(a)(i)permits the school board to employ an immediate family member of a <br /> school board member, provided the family member is certified to teach and teaching in a <br /> classroom. <br /> La. R.S. 42:1119C(2)provides that the provisions of this Section shall not prohibit the continued <br /> employment of any public employee nor shall it be construed to hinder, alter, or in any way affect <br /> normal promotional advancements for such public employee where a member of public <br /> employee's immediate family becomes the agency head of such public employee's agency, <br /> provided that such public employee has been employed in the agency for a period of at least one <br /> year prior to the member of the public employee's immediate family becoming the agency head. <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
