FAX:(225)381-7271 <br /> 1-800-842-6630 <br /> www.ethics.la.gov <br /> Monday, June 8, 2020 <br /> Phil Ashurst <br /> 1011 Montrose Blvd <br /> Lafayette, Louisiana 70503 <br /> Re: Ethics Board Docket No. 2020-365 <br /> Dear Mr. Ashurst: <br /> The Louisiana Board of Ethics,at its June 5,2020 meeting,considered your request for an advisory <br /> opinion as to whether you may accept employment with Populous, Inc. within two years of the <br /> termination of your employment as Operations Director of the Cajundome Commission. <br /> FACTS PROVIDED <br /> You stated that you were employed by the Cajundome Commission as an Operations Director and <br /> recently retired in April 2020. You also stated that as an Operations Director, you approved <br /> invoices for projects and served as a main point on contact with architecture firms who were <br /> working on projects with the Commission. You also stated that you received supervision from the <br /> Executive Director and exercised supervision over four different departments. However,you stated <br /> that you did not have the authority to select the companies who provided architectural work for <br /> the Cajundome. You stated that during your employment with Cajundome, you worked with and <br /> participated in multiple projects with Populous, Inc., an out of state architectural firm. You also <br /> stated that that you worked on and participated in several projects involving Sellers Broussard <br /> Joint Venture. You stated that for each of the projects you worked on with these firms while <br /> employed by Cajundome Commission, Rajun Cajun Facilities, Inc. was the entity that hired and <br /> paid the architecture firms. You stated that after you retire, yolf intend to work for Populous, Inc. <br /> but do not intend to receive any compensation from Populous, Inc. of the Cajundome for projects <br /> completed for or with the Cajundome. <br /> LAWS <br /> La. R.S. 42:1121A(1)provides no former agency head or elected official shall, for a period of two <br /> years following the termination of his public service as the head of such agency or as an elected <br /> public official serving in such agency, assist another person, for compensation, in a transaction, or <br /> in an appearance in connection with a transaction, involving that former agency or render any <br /> service on a contractual basis to or for such agency. <br /> La. R.S. 42:1121D provides that no former public servant shall share in any compensation <br /> received by another person for assistance which such former public servant is prohibited from <br /> rendering. <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
