R.S. 42:1124.2.1. <br /> FACTS PROVIDED <br /> On August 6, 2019, New Orleans City Mayor LaToya Cantrell issued Executive Order IC 19-C2 <br /> establishing the Infrastructure Advisory Board ("IAB"). The IAB was created to review spending <br /> of funds deposited into the Infrastructure Maintenance Fund provided for by a Cooperative Endeavor <br /> Agreement between the City of New Orleans and the New Orleans Sewerage and Water Board; to <br /> provide quarterly reports to the Mayor and Sewerage and Water Board on the IAB's activities; to <br /> make recommendations to the Mayor, Governor, the City Council, and the Legislature regarding <br /> identifying improvements or reforms necessary to ensure the Sewerage and Water Board is a high <br /> performing utility;and,to facilitate meaningful discussions within the IAB. Any recommendations <br /> made regarding the expenditure of funds is advisory only, and no entity is required to follow the <br /> recommendations of the IAB. <br /> LAWS <br /> La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or <br /> commission which has the authority to expend, disburse or invest $10,000 or more of funds in a <br /> fiscal year on or before May 15th of each year during which the person holds office and the year <br /> following termination of the holding of such office. <br /> CONCLUSION <br /> The Board concluded,and instructed me to inform you,that the Code of Governmental Ethics would <br /> not require the members of the Infrastructure Advisory Board to file annual personal financial <br /> disclosure statements pursuant to La.R.S.42:1124.2.1 since the IAB does not have the authority to <br /> expend, disburse, or invest $10,000 or more in funds in a fiscal year. <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
