Section 1119 of <br /> the Ethics Code provides in pertinent part: <br /> §1119. Nepotism <br /> B(1). No member of the immediate family of a member of a governing authority or the <br /> chief executive of a governmental entity shall be employed by the governmental entity. <br /> * * * <br /> D. A willful violation of this Section shall subject the agency head, member of the <br /> goverrYing authority, the public employee having authority to hire and fire the employee, <br /> the iminediate supervisor of the employee, whether or not such persons are immediate <br /> family members of the employee, and such employee, to disciplinary action and penalties <br /> provided by this Chapter <br /> 14. <br /> The following terms are defined in Section 1102 of the Ethics Code and are relevant when <br /> a.na_yzing the above Sections: <br /> * � * <br /> (2}(a.)(vi) defines "agency" for a member of a governing authority of a political <br /> subdivision, to mean the governmental entity. <br /> (3} defines "agency head"to mean the chief executive or administrative officer of <br /> an agency or any member of a board or commission who exercises supervision over <br /> the agency. <br /> (9} defines "elected official" to mean any person holding an office in a <br /> goverr..mental entity which is filled by the vote of the appropriate electorate. <br /> (11)defines"governing authority"to mean the body which exercises the legislative <br /> functions of a political subdivision. <br /> (12) c�.efines "governmental entity" to mean the state or any political <br /> subdivision...to which the elected official is elected. <br /> (13j defines"immediate family"to mean,as the term relates to a public servant,his <br /> children, the spouses of his children, his brothers and their spouses, his sisters and <br /> their spouses, his parents,his spouse, and the parents of his spouse. <br />
