Ethics Board Docket No. 2024-584 <br /> Page 3 of 7 <br /> list, or payroll for any payment or compensation from the state, for services not actually rendered <br /> by himself, or for services grossly inadequate for the payment or compensation received or to be <br /> received according to such employrnent list or payroll. <br /> 7. <br /> On December 3, 2024, Mr. Madere was sentenced for theft, payroll fraud and abuse of <br /> office, to ten years with the Department of Corrections, which was suspended with credit for time <br /> served, and three years of probation on the condition that he pay a $5,000.00 fine and $75,028.77 <br /> in restitution to the St. Charles Parish Sheriff's Office by December 3, 2025. He also served 12 <br /> months of GPS-monitored home incarceration. <br /> 8. <br /> Mr. Madere paid $75,028.77 in restitution and the $5,000.00 fine to the St. Charles Parish <br /> Sheriff's Office on December 3, 2024. <br /> IV. <br /> PROVISIONS OF LAW <br /> 9. <br /> La. R.S. 42:1111(A)(1)(a) provides that no public servant shall receive anything of <br /> economic value, other than the compensation and benefits from the governmental entity to which <br /> she is duly entitled, for the performance of the duties and responsibilities of her office or position. <br /> 10. <br /> The following terms are defined in Section 1102 of the Ethics Code and are relevant when <br /> analyzing the above Section: <br /> (12) "Governmental entity" means the state or any political subdivision which <br /> employs the public employee or employed the former public employee or <br /> to which the elected official is elected, as the case may be. <br />
