(18) "Public employee" means anyone, whether compensated or not, who is appointed by an elected official to serve as an employee of the governmental entity or an agency thereof. (19) "Public servant" means a public employee or an elected official. (22)(a) "Thing of economic value" means money or any other thing having economic value. 11. La. R.S. 42:1153(B)provides the following with respect to penalties: Upon a determination that any public employee or other person has violated any provision of any law within the jurisdiction of the Board of Ethics...the Ethics Adjudicatory Board may remove, suspend,or order a reduction in pay, or demotion of the public employee or other person, or impose a fine of not more than ten thousand dollars, or both. V. OPINION It is the opinion of the BOE that Rodney Madere, Jr., was a public servant while he was employed by the St. Charles Parish Sheriff's Office. It is the opinion of the BOE that Rodney Madere, Jr., in his capacity as an employee of the St. Charles Parish Sheriff's Office, violated La. R.S. 42:1111(A)(1)(a) by virtue of his receipt of items and unauthorize payments totaling$75,028.77,which he was not duly entitled to receive for the performance of his duties as an employee of the St. Charles Parish Sheriff's Office. If this matter proceeded to a public hearing before the Ethics Adjudicatory Board("EAB"), and the EAB found a violation of the Ethics Code, the EAB could impose a fine of up to ten thousand dollars ($10,000)pursuant to La.
