Ethics Board Docket No. 2024-584 <br /> Page 4 of 7 <br /> (17) "Political subdivision" means any unit of local government authorized to <br /> perform governmental functions. <br /> (18) "Public employee" means anyone, whether compensated or not, who is <br /> appointed by an elected official to serve as an employee of the governmental <br /> entity or an agency thereof. <br /> (19) "Public servant" means a public employee or an elected official. <br /> (22)(a) "Thing of economic value" means money or any other thing having <br /> economic value. <br /> 11. <br /> La. R.S. 42:1153(B)provides the following with respect to penalties: <br /> Upon a determination that any public employee or other person has violated any <br /> provision of any law within the jurisdiction of the Board of Ethics...the Ethics <br /> Adjudicatory Board may remove, suspend,or order a reduction in pay, or demotion <br /> of the public employee or other person, or impose a fine of not more than ten <br /> thousand dollars, or both. <br /> V. <br /> OPINION <br /> It is the opinion of the BOE that Rodney Madere, Jr., was a public servant while he was <br /> employed by the St. Charles Parish Sheriff's Office. <br /> It is the opinion of the BOE that Rodney Madere, Jr., in his capacity as an employee of the <br /> St. Charles Parish Sheriff's Office, violated La. R.S. 42:1111(A)(1)(a) by virtue of his receipt of <br /> items and unauthorize payments totaling$75,028.77,which he was not duly entitled to receive for <br /> the performance of his duties as an employee of the St. Charles Parish Sheriff's Office. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board("EAB"), <br /> and the EAB found a violation of the Ethics Code, the EAB could impose a fine of up to ten <br /> thousand dollars ($10,000)pursuant to La.
