Advisory opinion that the Code of Governmental Ethics would not prohibit the mother of a St. Helena Parish Police Juror from applying for Recovery Program funds through the U.S. Department of Housing and Urban Development (HUD), since the St. Helena Police Jury performs a purely ministerial function in providing the requested information to HUD and administering the payment to the contractors. However, the St. Helena Police Juror would be prohibited by La. R.S. 42:1112B(1) from participating in any matter in which his mother had a substantial economic interest. He would be required to recuse himself consistent with La. R.S. 42:1120.

However, La. However, both individuals should be aware that La. R.S. 42:1112B prohibits participation through their public position in matters involving a person whom they have contracts with and the duty to recuse himself from voting or discussion on any matters involving such persons.
