Advisory opinion that the Louisiana Code of Governmental Ethics would not prohibit a landlord in the Section 8 program of the Housing Authority of East Baton Rouge Parish from continuing to participate as a landlord in the Section 8 program pursuant to the terms and conditions in place at the time he married a social services analyst employed with the Section 8 program; however, he would be prohibited from entering into a new 12-month lease agreement with the Housing Authority, requesting a rent increase, or continuing as a landlord if the payment terms change for any reason. Additionally, the landlord would be required to disclose the income that he receives from the Housing Authority and the tenant, pursuant to La. R.S. 42:1114. Finally, a disqualification plan completely removing his spouse from any responsibility regarding the tenant residing in her husband’s unit should be submitted and approved by the Board.

Further, he would not be prohibited from participating in the vote regarding the annual appropriation to STARC, at a time when Gallagher serves as its benefits consultant, provided the funding is not allocated to compensate Gallagher for those services, since he is not an officer, director, trustee, partner, or employee of STARC.

Advisory opinion that the Louisiana Code of Governmental Ethics would not prohibit an elected member of the Terrebonne Parish Council from continuing her employment with Gilsbar, LLC., at a time when it has a contract of insurance with the Parish since she meets the exception created in Board Docket No. 82002D; however, she would be prohibited from voting on matters in which Gilsbar, LLC., has substantial economic interest, at a time when she is employed with Gilsbar. The councilwoman may participate in the debate or discussion concerning the matter involving Gilsbar, provided she discloses her conflict or potential conflict on the record of the Council prior to her participation in the debate or discussion and prior to the vote. Finally, she would be prohibited from monitoring employee health insurance claims for the Parish, administering group health benefit enrollments for new Parish employees, or performing any other duties on behalf of Gilsbar, pursuant to its contract of insurance with the Parish.
