sentencing, (4) comply with all lawful and general conditions of probation imposed by the <br /> probation officer, (5)pay the $75.00 monthly probationary fee to the probation office, and(6)pay <br /> restitution in the amount of$6,510.00 to the Houma Police Department, to be paid directly to the <br /> Houma Police Department by cashier's check or money order. <br /> 15. <br /> The following provisions of the Louisiana Code of Governmental Ethics are implicated by <br /> the alleged facts stated herein: <br /> (a) La. R.S. 42:1102(15) defines "participate" to mean to tale part in or to have <br /> responsibility for action of a governmental entity or proceeding, personally, as a public <br /> servant of the governmental entity, through approval, disapproval, decision, <br /> recommendation, the rendering of advice, investigation, or the failure to act or perform a <br /> duty. <br /> (b)La.R.S.42:1102(23) defines "Transaction involving the governmental entity"to mean <br /> any proceeding, application, submission, request for a ruling or other determination, <br /> contract, claim, case, or other such particular matter which the public servant or former <br /> public servant of the governmental entity in question knows or should know: (a) Is,or will <br /> be, the subject of action by the governmental entity. (b) Is one to which the governmental <br /> entity is or will be a party. (c) Is one in which the governmental entity has a direct interest. <br /> (d) La. R.S. 42:1111A prohibits a public employee from receiving anything of economic <br /> value, other than compensation and benefits from the governmental entity to which he is <br /> duly entitled,for the performance of the duties and responsibilities of his office or position. <br /> (e) La. R.S. 42:1112A prohibits a public servant from participating in a transaction in <br /> which he has a personal substantial economic interest of which he may be reasonably <br /> expected to know involving the governmental entity. <br /> (f)La.R.S.42:1153B provides that upon finding that any public employee or other person <br /> has violated any provision of any law within the jurisdiction of the board . . ., the board <br /> by a majority vote of the membership, may remove, suspend, or order a reduction in pay, <br /> or demotion of the public employee or other person, or impose a fine of not more than <br /> ten thousand dollars, or both. <br /> (g) La. R.S. 42:1155A provides that if an investigation pursuant to R.S. 42:1141 reveals <br /> that any public servant or other person has violated any law within the jurisdiction of the <br /> board to his economic advantage, the board may order the payment of penalties. <br /> Page 5 of 8 <br />
