16. <br /> La. R.S. 42:1102(23) dunes a "Transaction involving the governmental entity" as any <br /> proceeding, application, submission,request for a ruling or other determination, contract, claim, case, <br /> or other such particular matter which the public servant or former public servant of the governmental <br /> entity in question knows or should know: (a) is, or will be, the subject of action by the governmental <br /> entity; (b) is one to which the governmental entity is or will be a party; and, (c) is one in which the <br /> governmental entity has a direct interest. <br /> 17. <br /> Based on the foregoing, the BOE charges Mr. Temple with violating La. R.S. 42:1121(A)(1), <br /> La. R.S. 42:1121(A)(2), and La. R.S. 42:1121(B), by virtue of his execution of a lease, with RI, on <br /> behalf of HRG within two (2)years of resigning from the BCHI Board. Additionally,the BOE charges <br /> HRG with violating La. R.S. 42:1121(C) by virtue of HRG's assisting of RI in a transaction with its <br /> former agency, BCHI. <br /> 18. <br /> In accordance with La. R.S. 1141(C)(3)(b)(iv),the BOE designates LaToya D. Jordan and all <br /> BOE staff attorneys as the BOE's trial attorneys in this matter. <br /> WHEREFORE, the Louisiana Board of Ethics respectfully requests that the Ethics <br /> Adjudicatory Board: (1)conduct a hearing on the foregoing charge; (2)determine that Collis Temple, <br /> Jr. violated La. La. R.S. 42:1121(A)(1), La. R.S. 42:1121(A)(2), and La. R.S. 42:1121(B); (3) <br /> determine that Human Resource Group, Inc. violated La. R.S. 42:1121(C); and, (4) assess the <br /> appropriate penalties in accordance with the recommendation of the Louisiana Board of Ethics to be <br /> submitted during the public hearing on this matter or at another time deemed appropriated by the <br /> Ethics Adjudicatory Board. <br /> Page 5 of 6 <br />
