Advisory Opinion whereby the Code of Governmental Ethics would not prohibit Tracy Wells from qualifying in the Mayor's election for the City of Hammond while her husband, Devon Wells, serve as a Hammond City Councilman. However, should Tracy and Devon Wells serve as elected officals for the City of Hammond, they would be prohibited by the Code from participating in any transaction involving the City of Hammond in which either of them have a substantial economici interest and should recuse themselves from participating in such matters pursuant to La. R.S. 42:1120.

There are no provisions in the Code which prohibit spouses from running as candidates for elected <br /> office to the same political subdivision. <br /> However, in the event you are both elected to positions with the City of Hammond, you and your <br /> spouse will be prohibited by La. R.S. 42:1112B(1) from participating in any transaction involving <br /> the City of Hammond in which either of you have a substantial economic interest.You would need <br /> to recuse yourself from participating in such matters pursuant to La. R.S. 42:1120. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Governmental <br /> Ethics.
