ANALYSIS
La. R.S. 42:1113(B)prohibits an appointed member of any board or commission ... from bidding
on or entering into or being in any way interested in any contract, subcontract,or other transaction
which is under the supervision or jurisdiction of the agency of such appointed member. You are an
appointed member of the Museum's Board. The submission of your artwork to the Museum for
consideration, potential selection, and potential sale would be considered a contract or transaction
that is under the supervision of your agency—the Museum.
CONCLUSION
The Board concluded, and instructed me to inform you, that based on the facts presented, the Code
does prohibit you from submitting your work of art to the Museum's independent selection
committee to be juried and potentially sold at the En Plein Air exhibition.
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as
presented may result in a different application of the provisions of the Louisiana Code of
Governmental Ethics. The Board issues no opinion as to past conduct or as to laws other than the
Louisiana Code of Governmental Ethics, the Campaign Finance Disclosure Act, the Lobbyist
Disclosure Act, and the conflict of interest provisions contained in the Louisiana Gaming Control
Law. If you have any questions, please contact me at(800) 842-6630 or(225)219-5600.
Sincerely,
LOUISIANA BOARD OF ETHICS
L oy .Jordan
For the owd
Docket No.2021-055
