ANALYSIS <br /> La. R.S. 42:1113(B)prohibits an appointed member of any board or commission ... from bidding <br /> on or entering into or being in any way interested in any contract, subcontract,or other transaction <br /> which is under the supervision or jurisdiction of the agency of such appointed member. You are an <br /> appointed member of the Museum's Board. The submission of your artwork to the Museum for <br /> consideration, potential selection, and potential sale would be considered a contract or transaction <br /> that is under the supervision of your agency—the Museum. <br /> CONCLUSION <br /> The Board concluded,and instructed me to inform you,that based on the facts presented,the Code <br /> does prohibit you from submitting your work of art to the Museum's independent selection <br /> committee to be juried and potentially sold at the En Plein Air exhibition. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Louisiana Code of <br /> Governmental Ethics. The Board issues no opinion as to past conduct or as to laws other than the <br /> Louisiana Code of Governmental Ethics, the Campaign Finance Disclosure Act, the Lobbyist <br /> Disclosure Act, and the conflict of interest provisions contained in the Louisiana Gaming Control <br /> Law.
