If an investigation conducted pursuant to this Part reveals that any public servant <br /> or other person has violated any law within the jurisdiction of the Board of Ethics <br /> to his economic advantage, and after an adjudicatory hearing on the matter, the <br /> Ethics Adjudicatory Board may order the payment of penalties. Recovery may <br /> include, in addition to an amount equal to such economic advantage, penalties not <br /> to exceed one half of the amount of the economic advantage. <br /> V. OPINION <br /> It is the opinion of the BOE that Amy Hebert,while serving as a member of the Lafourche <br /> Parish Tourist Commission, and Amplify-Events and Promotions, LLC, a limited liability <br /> company in which Amy Hebert exercises control, violated La. R.S. 42:1111C(2)(d) by receiving <br /> a thing of economic value for services rendered to Lafourche Are at a time when Lafourche Arc <br /> had a contractual, business or financial relationship with the Lafourche Parish Tourist <br /> Commission. It is the opinion of the BOE that Amy Hebert, while serving as a member of the <br /> Lafourche Parish Tourist Commission, and Amplify-Events and Promotions, LLC, a limited <br /> liability company in which Amy Hebert exercises control, violated La. R.S. 42:1111E(1) by <br /> receiving a thing of economic value for assisting Lafourche Arc in the preparation and submission <br /> of a grant application to the Lafourche Parish Tourist Commission. <br /> As an appointed member of the Lafourche Parish Tourist Commission,Amy Hebert was a <br /> public servant as defined in La. R.S. 42:1102(19). Her agency, as defined by La. R.S. <br /> 42:1102(a)(iv), is the Lafourche Parish Tourist Commission. <br /> Lafourche Arc is a private nonprofit that was seeking grant funds from the Lafourche <br /> Parish Tourist Commission, and entered into a Cooperative Endeavor Agreement with Lafourche <br /> Parish Tourist Commission once the grant funds were awarded to Lafourche Arc. <br /> As an appointed member of the Lafourche Parish Tourist Commission, Amy Hebert, and <br /> any person in which her ownership percentage exceeded 25%, was prohibited from receiving a <br /> Page 10 of 16 <br />
