La. R.S. 42:1102(13). "Immediate family," as the tenn relates to a public servant, means his <br /> children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, <br /> his parents, his spouse, and the parents of his spouse. <br /> La. R.S. 42:1102(16) defines "person" to mean an individual or legal entity other tha�� a <br /> governmental entity, or an agency thereof. <br /> La. R.S. 42:1102(19) defines "public servant"to mean a public employee or elected official. <br /> ANALYSIS <br /> As an elected member of the East Feliciana Parish School Board, Peidera Sims-Matthews is a <br /> public servant pursuant to La. R.S. 42:1102(19). Her agency is the East Feliciana Parish School <br /> System and all schools under its jurisdiction pursuant to La. R.S. 42:1102(2)(a)(vi). As the <br /> biological daughter of Ms. Sims-Matthews, you are her immediate family member as defined by <br /> La. R.S: 42:1102(13). <br /> La. R.S. 42:1113A prohibits an immediate family member of a public servants from entering into <br /> subcontracts and/or transactions under the supervision or jurisdiction of the public servant's <br /> agency. As you would be providing services to the East Feliciana Parish School System through <br /> the contract between Kelly Services and the east Feliciana Parish School System, you would be <br /> entering into a prohibited subcontract and/or transaction with your mother's agency. <br /> CONCLUSION <br /> The Board concluded,and instructed me to inform you,that the Code prohibits you from providing <br /> services to any school within the East Feliciana Parish School System through a contract between <br /> Kelly Services and East Feliciana School System while your mother serves as a member of the <br /> East Feliciana Parish School Board. <br /> Changes to the facts as presented may result in a different application of the provisions of the <br /> Louisiana Code of Governmental Ethics.
