LAW La.R.S.42:1121A(2)provides that no former member of a board or commission shall,for a period of two years following the termination of his public service on such board or commission,contract with,be employed in any capacity by,or be appointed to any position by that board or commission. La. R.S. 42:1102(10) defines "governing authority" to mean the body which exercises the legislative functions of a political subdivision. La.R.S. 42:1102(11) defines "governmental entity" to mean the state or any political subdivision which employs the public employee or employed the former public employee or to which the elected official is elected, as the case may be. ANALYSIS The Slidell City Council acts as the legislative branch of the government for Slidell; as such the Slidell City Council is a governing authority as provided by La. R.S. 42:1102(10). The agency of a Slidell Council member is the governmental entity, the political subdivision of Slidell, pursuant to La. R.S. 42:1102(2)(a)(vi) and La. R.S. 42:1102(11). La. R.S. 42:1121(A)(2)provides that, for a period of two years following the termination of his or her service as an elected member of the Slidell City Council, no former member or a board or commission shall be employed in any capacity by, or be appointed to any position by that board or commission. The Board has previously interpreted "boards or commissions" to include parish councils. Since you would hire the former council member and the Slidell City Council is not required nor will it approve the hiring,a former Slidell City Council member is not prohibited from being hired by you to work for the City of Slidell within two years of the termination of his term of office. CONCLUSION The Board concluded, and instructed me to inform you, that the Code permits you to hire a former Slidell City Council member to work for the City of Slidell, and the former councilmember is not required to wait two years from their termination of office in order to accept the employment.
