ANALYSIS <br /> Generally, La. R.S. 42:1111C(2)(d) prohibits Paul Maassen from rendering compensated services <br /> to Public Radio Inc. since Public Radio Inc. has a contractual, business, or financial relationship <br /> with Mr. Maassen's agency, the UNO radio station WWNO. Additionally, La. R.S. 42:1117 <br /> prohibits Public Radio Inc. from making such prohibited payments to Paul Maassen. <br /> However, the limited exception in La. R.S. 42:1123(9)(b) applies in this specific instance, as the <br /> proposed consulting contract between Paul Maassen and Public Radio Inc. is related to Mr. <br /> Maassen's academic discipline at UNO and has been properly approved by UNO President Kathy <br /> Johnson according to the procedures previously approved by the Board. <br /> The Board cautioned that La. R.S. 42:1112B(5) prohibits Mr. Maassen from participating in his <br /> capacity as an employee of UNO in any transaction in which Public Radio Inc. has a substantial <br /> economic interest, while he as a contractual relationship with Public Radio Inc. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the proposed consulting contract <br /> between Public Radio Inc. and Paul Maassen meets the requirements of La. R.S. 42:1123(9)(b). <br /> Accordingly, the proposed consulting agreement presents no potential violation of the Code. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Governmental <br /> Ethics.
