Caption
The Code of Governmental Ethics does not prohibit members of the Louisiana Addictive Disorder Regulatory Authority (ADRA) from being members of the Louisiana Association of Substance Abuse Counselors and Trainers, Inc. (LASACT) while LASACT seeks to or enters into a lease agreement with ADRA; nor does it prohibit the ADRA members from participating in a vote involving such a lease agreement.

Benefits of a LASACT membership include: discounts on all LASACT events, <br /> access to LASACT Lagniappe (weekly newsletter), priority messaging on upcoming events, and <br /> priority exam scheduling. <br /> ADRA is seeking to enter into a lease for office space with LASACT. The ADRA is seeking an <br /> advisory opinion to determine if this creates a conflict of issue with any of the members of the <br /> ADRA and whether the members of the ADRA can participate in the vote to enter into the lease <br /> with LASACT. <br /> L,�w <br /> La. R.S. 42:1111C(2).No public servant and no legal entity in which the public servant exercises <br /> control or owns an interest in excess of twenty-five percent, shall receive any thing of economic <br /> value for or in consideration of services rendered, or to be rendered, to or for any person during <br /> his public service unless such services are: <br /> (d)Neither performed for nor compensated by any person from whom such public servant <br /> would be prohibited by R.S. 42:1115(A)(1)or(B) from receiving a gift. <br /> La. R.S. 42:1115A. No public servant shall solicit or accept, directly or indirectly, any thing of <br /> economic value as a gift or gratuity from any person or from any officer, director, agent, or <br /> employee of such person, if such public servant knows or reasonably should know that such <br /> person: <br /> (1) Has or is seeking to obtain contractual or other business or financial relationships with <br /> the public servant's agency. <br /> La. R.S. 42:1115B. No public employee shall solicit or accept, directly or indirectly, any thing of <br /> economic value as a gift or gratuity from any person or from any officer, director, agent, or <br /> employee of such person, if such public servant knows or reasonably should know that such <br /> person: <br /> (1) Conducts operations or activities which are regulated by the public einployee's agency. <br /> La. R.S. 42:1112A prohibits a public servant from participating in a transaction in which he has a <br /> personal substantial economic interest of which he may be reasonably expected to know involving <br /> the governmental entity. <br /> La. R.S. 42:1112B(3) states that no public servant shall participate in a transaction involving the <br /> governmental entity in which, to his actual knowledge, any person of which he is an officer, <br /> director,trustee,partner, or employee has a substantial economic interest. <br /> La.
