Box 2001 <br /> Thibodaux, Louisiana 70310 <br /> Re: Docket No. 2025-258 <br /> Advisory Opinion <br /> Dear President Clune: <br /> The Louisiana Board of Ethics, at its August 8, 2025 meeting, considered your request for an <br /> advisory opinion regarding whether the Code of Governmental Ethics (the "Code") prohibits <br /> businesses owned by Amanda Enclade Fremin's father-in-law and husband to enter into <br /> transactions with Nicholls State University while she is employed in the Office of Student Affairs; <br /> and, a request to adopt a disqualification plan for Amanda Enclade Fremin. <br /> FACTS <br /> Amanda Enclade Fremin has been employed with Nicholls State University since June of 1999. <br /> Mrs.Fremin currently serves as the Assistant to the Vice President of Student Affairs. Mrs.Fremin <br /> disclosed several businesses owned by her father-in-law,Dale Fremin, and her husband, Donovan <br /> Fremin, to her supervisor, Dr. Michele Caruso, Vice President of Student Affairs. A list of these <br /> businesses is on file with her supervisor. <br /> Occasionally,Nicholls State University engages with one or more of these businesses,which may <br /> require corroboration with the Office of Student Affairs. As of today, no contracts exist between <br /> the Office of Student Affairs and any of the businesses owned by Dale and Donovan Fremin.Mrs. <br /> Fremin has not participated in any contract or transactions between other Nichols University <br /> Departments and the businesses owned by Dale and Donovan Fremin. <br /> LAW <br /> La.R.S.42:1113(A)(1)(a)No public servant,excluding any legislator and any appointed member <br /> of any board or commission and any member of a governing authority of a parish with a population <br /> of ten thousand or less, or member of such a public servant's immediate family, or legal entity in <br /> which he has a controlling interest shall bid on or enter into any contract, subcontract, or other <br /> transaction that is under the supervision or jurisdiction of the agency of such public servant. <br /> Page 1 of 3 (BD 2025-258) <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
