such person: (1) Has or is seeking to obtain contractual or other business or financial <br /> relationships with the public servant's agency. <br /> La. R.S. 42:1102(2)(a)(i) defines "agency" to mean a department, office, division, agency, <br /> commission, board, committee, or other organizational unit of a governmental entity. <br /> La.R.S. 42:1102(3)defines"agency head"to mean (3) "Agency head"means the chief executive <br /> or administrative officer of an agency or any member of a board or commission who exercises <br /> supervision over the agency. <br /> La. R.S. 42:1102(18)(a)(ii) defines "public employee' as any person who is appointed by any <br /> elected official when acting in an official capacity, and the appointment is to a post or position <br /> wherein the appointee is to serve the governmental entity or an agency thereof, either as a member <br /> of an agency, or as an employee thereof. <br /> La. R.S. 42:1102(19) defines"public servant"to include a public employee or an elected official. <br /> ANALYSIS <br /> Pursuant to La. R.S. 17:3999B(20)the Avoyelles Public Charter School is subject to the Code of <br /> Governmental Ethics. If appointed, Hope Gagnard's agency would be the Avoyelles Public <br /> Charter School Board pursuant to La. R.S. 42:1102(2)(a)(i). As an appointed member of a Board, <br /> the CPA is a public employee and public servant pursuant to 42:1102(18) and 1102(19). <br /> If appointed, La. R.S. 42:1111C(2)(d) would prohibit a public servant, from receiving any thing <br /> of economic value for or in consideration of services rendered, or to be rendered, to or for any <br /> person during her public service that has a contractual relationship with their agency. <br /> CONCLUSION <br /> The Board concluded and instructed me to inform you that the Code of Governmental Ethics <br /> prohibits Hope Gagnard from rendering compensated services to Ducote and Company while it <br /> has a contractual relationship with the Avoyelles Public Charter School if Hope Gagnard is <br /> promoted to the Avoyelles Public Charter School Board. <br /> Changes to the facts as presented may result in a different application of the provisions of the <br /> Louisiana Code of Governmental Ethics. The Board issues no opinion as to past conduct or as to <br /> laws other than the Louisiana Code of Governmental Ethics, the Campaign Finance Disclosure <br /> Act,the Lobbyist Disclosure Acts,and the conflict of interest provisions contained in the Louisiana <br /> Gaming Control Law. <br /> Page 2 of 3 (BD 2025-550) <br />
