Ethics Board Docket No. 2019-1103 <br /> Mr. Peter Barbera <br /> November 20,2019 <br /> Page 2 <br /> CONCLUSION <br /> The Board concluded,and instructed me to inform you,that the Code of Governmental Ethics does <br /> not prohibit Barbera Chevrolet from entering into transactions with Assumption Parish, the <br /> Assumption Parish Water Works District or any other Assumption Parish subsidiary. However, if <br /> Barbera Chevrolet has, or seeks to have, such a relationship with the parish or its subsidiaries, <br /> Barbera becomes a prohibited source of income for an elected officials of the parish and certain other <br /> public servants affiliated with the parish or its subsidiaries pursuant to La.R.S.42:11.11 C(2)(d).This <br /> prohibition would extend to income earned by an elected official's spouse or a public servant's <br /> spouse. Therefore,La. R.S. 42:1117 would prohibit Barbera Chevrolet from making payments to <br /> an elected official and certain public employees, or their respective spouses, if Barbera seeks a <br /> contractual, business or financial relationship with the parish. <br /> If Barbera Chevrolet is seeking to transact business with Assumption Parish or any of it subsidiaries, <br /> please request an advisory opinion as to those facts for more specific guidance as to the application <br /> of the Code of Governmental Ethics. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board <br /> issues no opinion as to past conduct or as to laws other than the Code of Governmental Ethics.
