Ethics Board Docket No. 2024-395 <br /> Page 6 of 10 <br /> §1102. Definitions <br /> Unless the context clearly indicates otherwise,the following words and terms,when used in <br /> this Chapter, shall have the following meanings: <br /> (2)(a)(iv) defines "agency" to mean for public servants of political subdivisions, it <br /> shall mean the agency in which the public servant serves, except that for members of <br /> any governing authority and for the elected or appointed chief executive of a <br /> governmental entity,it shall mean the governmental entity.Public servants of political <br /> subdivisions shall include, but shall not be limited to, elected officials and public <br /> employees of municipalities, parishes, and other political subdivisions; sheriffs and <br /> their employees;district attorneys and their employees;coroners and their employees; <br /> and clerks of court and their employees.. <br /> (9)defines "elected official"to mean any person holding an office in a governmental <br /> entity which is filled by the vote of the appropriate electorate. It shall also include any <br /> person appointed to fill a vacancy in such offices. <br /> (16)defines"person"to mean an individual or legal entity other than a governmental <br /> entity, or an agency thereof. <br /> (19) defines "public servant" to mean a public employee or an elected official. <br /> (20.1) defines"service"to mean the performance of work,duties,responsibilities,or <br /> the leasing, rental, or sale of movable or immovable property. <br /> 3. <br /> The following provisions proscribe the penalties the Ethics Adjudicatory Board may assess <br /> if the Ethics Adjudicatory Board determines a violation of the Code of Governmental Ethics has <br /> occurred: <br /> §1153. Penalties <br /> A. Upon a determination that any elected official or other person has violated any <br /> provision of any law within the jurisdiction of the Board of Ethics except violations <br /> of the Campaign Finance Disclosure Act which shall be governed by Chapter 11 of <br /> Title 18 of the Louisiana Revised Statutes of 1950, the Ethics Adjudicatory Board <br />
