Ethics Board Docket No. 2024-395 <br /> Page 7 of 10 <br /> may censure the elected official or person, or impose a fine of not more than ten <br /> thousand dollars, or both. <br /> §1155. Penalties <br /> A. lf an investigation conducted pursuant to this Part reveals that any public servant <br /> or other person has violated any law within the jurisdiction of the Board of Ethics to <br /> his economic advantage, and after an adjudicatory hearing on the matter, the Ethics <br /> Adjudicatory Board may order the payment of penalties. Recovery may include, in <br /> addition to an amount equal to such economic advantage,penalties not to exceed one <br /> half of the amount of the economic advantage. <br /> V. <br /> OPINION: <br /> It is the opinion of the Board that David Duplechein, while he served as an elected member <br /> of the Ascension Parish School Board, violated La. R.S. 42:1111C(2)(d)by virtue of his receipt of <br /> compensation for services rendered to Hughes Insurance Services, L.L.C. while Hughes Insurance <br /> Services, L.L.C_ had a contractual, business and financial relationship with the Ascension Parish <br /> School Board. <br /> As an elected member of the Ascension Parish School Board, Mr. Duplechein was a public <br /> servant subject to the provisions of Code of Governmental Ethics. His agency,as defined by La_R.S. <br /> 42:1102(a), was the Ascension Parish School District. <br /> Hughes Insurance Services, L.L.C.. is a person as defined by La. R.S. 42:1102(16) as it is a <br /> private limited liability company. <br /> As an elected member of the Ascension Parish School Board,Mr.Duplechein was prohibited <br /> from receiving a thing of economic value for services rendered to a person that has or was seeking <br /> to have a contractual, or other business or financial relationship with the school board. Therefore, <br /> Mr.Duplechien's receipt of commissions for services rendered to Hughes Insurance Services,L.L.C. <br /> while Hughes Insurance Services, L.L.C. had contractual, business and financial relationships with <br />
