Ethics Board Docket No.2422-455 <br /> Page 7 of12 <br /> reimbursement far such expenses,if the agency head of the public servant's agency certifies <br /> each of the following: <br /> (1)The public servant's acceptance of complimentary adrrkission, lod�ing, and reasonable <br /> transporta.tion,or reimbursement for such expenses,is either of direct benefit to the agency <br /> or will enhance tlne knowledge or skill of the public servant as it relates to the perfomnance <br /> of his public service_ <br /> (2)The agency head approved the public servant's aeceptanee of complimentary admission, <br /> lodging, ar�d reasonable tzansportation, or reimbursement for such expenses, prior to <br /> acceptance. <br /> B.(1} Any public servant who accepts complimentary admission, lodging, or <br /> transportation, or reinnbursement for such expenses, shall file with the Board of Ethics, <br /> within sixty days after such acceptance, a certification, on a form designed by the board, <br /> disclosing all of the foliowing: <br /> (a) The date and location of complimentary admission, lod�ing, or <br /> transportation and a bnief description of its purpose. <br /> (b)The name of the person who gave,provided,paid for,or reizrxbwrsed in <br /> whole or in part the admission,lodging,or transportation. <br /> (c) The amount expended on his behalf or reimbursed by the person for <br /> admission, lodging, azxd transportation. <br /> (2) The certification required by this Subsection shall include the certifications of the <br /> agency head required by Subsection A of this Section <br /> 3. <br /> The following ternns are defined in Section 1102 of the Ethics Code and are relevant when <br /> analyzin�the above Sections: <br /> * � * <br /> (2)(a}{i) provides that the "aaency" for a public servant in the twenry principat <br /> departments of the executive branch of state government,the office in which such <br /> publie servant carries out his primary responsibilities,except that in the case of the <br /> secretary,deputy secretary,or undersecretary of any such deparhnent and o�cials <br /> carrying out the responsibilities of such deparEment officers it shall mean the <br /> departnnent in which he serves. <br /> (9) defines "elected official" to mean any person holdin; an office in a <br /> �overnmental entity which is filled by the vote of the appropriate electorate. <br />
