Advisory opinion that a former Town of Slaughter Alderman would be prohibited by the Code of Governmental Ethics from being appointed by the Slaughter Board of Aldermen to fill a vacany for Slaughter Chief of Police, but would not be prohibited from being appointed by the Governor of Louisiana to fill such vacancy. The appointment by the Governor would not prohibit the appointed person from being eligible or qualifying in the next election as a candidate for the office.

Robert Jackson <br /> Mayor, Town of Slaughter <br /> 3337 Church Street <br /> Post Office Box 29 . <br /> Slaughter, LA 70777 <br /> RE: Ethics Board Docket No. 2017-886 <br /> Dear Mayor Jackson: <br /> The Louisiana Board of Ethics, at its August 18, 2017 meeting, considered your request for an <br /> advisory opinion concerning the imposition of post-employment restrictions relative to former <br /> Slaughter Alderman,Dave Almond should he be appointed to fill the vacancy of the Slaughter Chief <br /> of Police. You stated that the Chief of Police,Walter Smith,resigned his position effective July 15, <br /> 2017,leaving the Town of Slaughter without a police chief. You further provided that the town has <br /> actively sought applicants, however because the guidelines call for the Chief to be a resident of <br /> Slaughter, which has a small population of approximately 1,000 residents, only two individuals <br /> applied for the position. One of the applicants,Dave Almond,is currently an alderman for the Town <br /> of Slaughter, who would resign his position if he were appointed as interim Chief of Police. <br /> You stated that the Louisiana Secretary of State has imposed a deadline of August 14,2017 to appoint <br /> someone to fill the vacancy for the Chief of Police. In the event that the Board of Aldermen does not <br /> appoint someone to fill the vacancy,the Governor of Louisiana would then make the appointment. <br /> You further provided that neither you, as Mayor, nor the Board of Aldermen would make a <br /> recommendation to the Governor as to who should be appointed interim Chief of Police. <br /> Finally,you questioned whether a person appointed interim Chief of Police would be eligible to run <br /> • for the office to fill the vacancy during the next available election cycle. <br /> The Board concluded and instructed me to inform you that the Code of Governmental Ethics would <br /> prohibit the Slaughter Board of Aldermen from appointing a former alderman to fill a vacancy for <br /> Slaughter Chief of Police,but not prohibit a former alderman from being appointed by the Governor <br /> of Louisiana to fill a vacancy for the position of Chief of Police. <br /> Page 1 of 2 <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
