. <br /> La. R.S. 42:1102 provides the following relevant definitions when analyzing the above <br /> Section: <br /> (2)(a)(vi)" gency"'for public servants of political subdivisions means the agency <br /> in which the public servant serves, except that for members of any governing <br /> authority and for the elected or appointed chief executive of a governmental entity, <br /> it shall mean the governmental entity. public servants of political subdivisions <br /> shall include, but shall not be limited to, elected officials and public employees of <br /> municipalities, parishes, and other political subdivisions. <br /> (12) " ovemmental entity" means the state or any political subdivision which <br /> employs the public employee or employed the former public employee or to which <br /> the elected official is elected, as the case may be. <br /> (17) defines "political subdivision" to mean any unit of local government, <br /> R. a special district, authorized by lav to perform governmental functions. <br /> (18)(a)"Public employee"means anyone,whether compensated or not,who is.- (i) <br /> An administrative officer or official of a.governmental cntity who is not filling an <br /> elective office; (ii) Appointed by any elected official when acting in an official <br /> capacity, and the appointment is to a post or position wherein the appointee is to <br /> serve the governmental entity or an agency thereof, either as a member of an <br /> agency, or as an employee thereof; (iii) Engaged in the performance of a <br /> governn-lental function; or (iv) finder the supervision or authority of an elected <br /> official or another employee of the governmental entity. <br /> (19) "public servant"'means a public employee or elected official. <br /> (22)(a) "Thing of economic value" means money or any other thing having <br /> economic value. <br /> . <br /> Iia. D.S. 42:1153B provides the following with respect to penalties for violations of the <br /> Code of Governmental Ethics; <br /> Upon a determination that any public employee or other person has violated <br /> any provision of any lave within the jurisdiction of the Board of Ethics except <br /> violations of the Campaign Finance Disclosure.Act which shall he governed by <br /> Chapter 11 of Title 18 of the Louisiana Devised Statutes of 1950, the Ethics <br /> daudleatory Board may remove, suspend, or order a reduction in pay, or <br /> Page 4 of 6 Docket No. 2024-089) <br />
