servant of the governmental entity, through approval, disapproval, decision, recommendation, the rendering of advice, investigation, or the failure to act or perform a duty. (b)La. R.S. 42:1102(15)defines "person"to mean an individual or legal entity other than a governmental entity, or an agency thereof. (c)La.R.S..42:11112(23)defines "Transaction*involving,theovernmental enti " to mean any proceeding, application, submission, request for a ruling or other deterrnination, contract, claim, case, or other such particular matter Which the public servant or former public servant of the governmental entity in question knows or should know: (a) Is,or will be, the subject of action by the governmental entity. (b) Is one to which the governmental entity is or will be a party. (c) Is one in which the governmental entity has a direct interest. (d) La. R.S. 42:1111A prohibits a public employee from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled,for the performance of the duties and responsibilities of his office or position. (e) La. R.S. 42A 112A prohibits a public servant from participating in a transaction in which he has a personal substantial economic interest of which he may be reasonably expected to know involving the governmental entity. [f] La. R.S. 42:1112B(3) states that no public servant shall participate in a transaction involving the governmental entity in which,to his actual knowledge, any person of which he is an officer, director,trustee,partner, or employee has a substantial economic interest. (g)La.R.S.42:1153B provides that upon finding that any public employee or other person has violated any provision of any law within the jurisdiction of the board . . ., the board by a majority vote of the membership, may remove, suspend, or order a reduction in pay, or demotion of the public employee or other person, or impose a.fine of not more than ten thousand dollars, or both. (h) La. R.S. 42:1155A provides that if an investigation pursuant to R.S. 42:1141 reveals that any public servant or other person has violated any law within the jurisdiction of the board to his economic advantage, the board may order the payment of penalties. Recovery may include, in addition to an amount equal to such economic advantage, penalties not to exceed one half of the amount of the economic advantage. 28.
