servant of the governmental entity, through approval, disapproval, decision, <br /> recommendation, the rendering of advice, investigation, or the failure to act or perform a <br /> duty. <br /> (b)La. R.S. 42:1102(15)defines "person"to mean an individual or legal entity other than <br /> a governmental entity, or an agency thereof. <br /> (c)La.R.S..42:11112(23)defines "Transaction*involving,theovernmental enti " to mean <br /> any proceeding, application, submission, request for a ruling or other deterrnination, <br /> contract, claim, case, or other such particular matter Which the public servant or former <br /> public servant of the governmental entity in question knows or should know: (a) Is,or will <br /> be, the subject of action by the governmental entity. (b) Is one to which the governmental <br /> entity is or will be a party. (c) Is one in which the governmental entity has a direct interest. <br /> (d) La. R.S. 42:1111A prohibits a public employee from receiving anything of economic <br /> value, other than compensation and benefits from the governmental entity to which he is <br /> duly entitled,for the performance of the duties and responsibilities of his office or position. <br /> (e) La. R.S. 42A 112A prohibits a public servant from participating in a transaction in <br /> which he has a personal substantial economic interest of which he may be reasonably <br /> expected to know involving the governmental entity. <br /> [f] La. R.S. 42:1112B(3) states that no public servant shall participate in a transaction <br /> involving the governmental entity in which,to his actual knowledge, any person of which <br /> he is an officer, director,trustee,partner, or employee has a substantial economic interest. <br /> (g)La.R.S.42:1153B provides that upon finding that any public employee or other person <br /> has violated any provision of any law within the jurisdiction of the board . . ., the board <br /> by a majority vote of the membership, may remove, suspend, or order a reduction in pay, <br /> or demotion of the public employee or other person, or impose a.fine of not more than <br /> ten thousand dollars, or both. <br /> (h) La. R.S. 42:1155A provides that if an investigation pursuant to R.S. 42:1141 reveals <br /> that any public servant or other person has violated any law within the jurisdiction of the <br /> board to his economic advantage, the board may order the payment of penalties. <br /> Recovery may include, in addition to an amount equal to such economic advantage, <br /> penalties not to exceed one half of the amount of the economic advantage. <br /> 28. <br /> Based on the foregoing facts herein, Dulce Michelen, while serving as the Business <br /> Manager for the St. John the Baptist Parish Library (the "Library"), violated La.
